The liquidators will gather as much information as possible from creditors and customers of Guavapay about payments made to or owed by Guavapay.

No. The Financial Services Compensation Scheme[3] (FSCS) only applies to certain types of activity. This does not include payment services.

Payments firms need to comply with requirements on how to protect customers’ money, known as ‘safeguarding’. 

The liquidators will assess any funds held by the firm to work out which, if any, are safeguarded for customers, and which belong to the firm. Where possible, the liquidator will then look to return any identified money to customers, subject to the deduction of costs.

Following the winding-up order, the liquidators are responsible for Guavapay, but Guavapay continues to be FCA-authorised.

The liquidators are officers of the court and need to comply with all insolvency law. 

We will work with the liquidators as appropriate.

If you are approached by a company offering to help you recover your money, you should proceed with caution. For most of Guavapay’s customers, there will be no benefit in involving a third party in making a claim.

When Guavapay provided regulated payment services it was required to hold its customers’ money separately from its own. The way in which this money needs to be held is set out in the EMRs and the Payment Services Regulations 2017 (PSRs) and is referred to as safeguarded funds.

Safeguarding is a key consumer protection measure within the EMRs and the PSRs. The purpose of safeguarding is to protect customer funds if a firm fails.
