Jury discharged in insider dealing trial without a verdict

Having been unable to reach a verdict in a trial at Southwark Crown Court brought by the Financial Conduct Authority (FCA), the jury was discharged. The FCA will now consider whether to seek a re-trial of Stuart Bayes and Jonathan Swann[1] for insider dealing.

Notes to editors

1. Stuart Bayes’ date of birth is 11 January 1966.
2. Jonathan Swann’s date of birth is 27 September 1971. 
3. Insider dealing is a criminal offence punishable, on conviction, by a fine and / or up to 7 years’ imprisonment 
4. Mr Bayes faced 3 counts of insider dealing on the indictment: one of dealing and two alternative counts alleging that he either disclosed inside information to Mr Swann or encouraged him to deal whilst in possession of inside information. Mr Swann faced one count of dealing.
