On 15 January 2015 we consulted on draft guidance setting out our powers and procedures in relation to conducting market studies under FSMA or under the Enterprise Act 2002 (EA02) and referring markets to the Competition and Markets Authority for in-depth investigation under EA02.

Our consultation[2] closed on 13 March 2015. We have considered the comments received and published a Policy Statement[3] summarising the feedback and setting out our responses. We have made some amendments to the guidance in light of comments received and following further review. A comparison against the draft we consulted on is available as Appendix 2 of the Policy Statement.
We are also publishing finalised guidance[4] on our powers and procedures to enforce against breaches of the Competition Act 1998 and the competition prohibitions in the Treaty on the Functioning of the European Union.
